Class VI Affected Person Protest Instructions
Affected persons may protest applications by requesting a contested case hearing in writing.
An affected person is a person who, as a result of the activity sought to be permitted, has suffered or may suffer actual injury or economic damage other than as a member of the general public, 16 TAC § 5.102(1).
A contested case hearing is a legal proceeding similar to a trial in district court. Contested case hearings are presided over by an Administrative Law Judge who will determine whether members of the public are affected persons entitled to a hearing.
If you believe you are an affected person, please provide the following information in your request:
- Name,
- Mailing address,
- Email address,
- The name and permit no. of the project you are protesting, and
- The basis of your protest, including an explanation of why you believe you will suffer actual injury or economic damage.
The RRC may evaluate protests to determine whether they were submitted by an affected person. Please submit your protest and request for a contested case hearing by either:
- Email to SlP@rrc.texas.gov or
- United States Mail to:
Railroad Commission of Texas
Oil and Gas Division
Special Injection Permits Unit
P.O. Box 12967
Austin, TX 78711-2967
Please be advised that you may not receive confirmation of your submitted protest until the permit application has been referred to the Hearings Division.
Do not submit a protest via the online Class VI Public Comment Form. A protest that is filed improperly may delay processing of your request. However, if you would like to submit public comment only, you may submit using the online Class VI Public Comment Form.
