Failure to File
Second notice - 30 days past the due date, the Commission sends the operator a second notice of the need to file Form H-10.
Continued delinquency - Enforcement action is initiated 30 days after the second notice if the operator has not contacted Technical Permitting regarding compliance.
- The well is sealed if no production exists on lease.
- The lease pipeline connection is severed if production exists.
NOTE: Always respond to Commission requests to avoid unnecessary enforcement action. The Commission will work with an operator who is making a diligent effort to comply.
