Audit Privilege Act Guide
At the August 9, 2016, open meeting, the Railroad Commission of Texas (Commission) adopted the Guide for Submissions Pursuant to the Texas Environmental, Health and Safety Audit Privilege Act, Tex. Civ. Stat. art. 4447cc (“Audit Act”). Under the Audit Act, persons who conduct voluntary environmental or health and safety audits of Commission regulated facilities and operations can claim immunity from administrative penalties for violations discovered, disclosed, and corrected within a reasonable amount of time. The Audit Act also provides a limited evidentiary privilege for audit reports developed in accordance with the Audit Act.
The Guide is a resource for those persons who provide notice of an audit to the Commission and voluntarily disclose violations of environmental or health and safety laws, rules and regulations under the Commission’s jurisdiction in accordance with the Audit Act.
